Note: This handles the common heirs (spouse, sons, daughters, parents) and the rule that a son receives double a daughter. Cases with siblings or grandparents need a qualified scholar.
How Islamic Inheritance Works
Islamic inheritance law is one of the most precise systems in the Shariah, derived mainly from Surah An-Nisa (4:11-12). Before distribution, the estate is settled in this order:
- Pay funeral expenses.
- Clear all debts of the deceased.
- Honour any bequest (Wasiyyah) up to a maximum of 1/3 (not to existing heirs).
- Divide the remainder among the legal heirs by fixed shares.
Fixed Shares Of Common Heirs
| Heir | With children | Without children |
|---|---|---|
| Husband | 1/4 | 1/2 |
| Wife | 1/8 | 1/4 |
| Mother | 1/6 | 1/3 (most cases) |
| Father | 1/6 + residue | residue |
| Sons & daughters | Take the remaining estate; each son = 2 × each daughter | |
The 2:1 Principle
Why a son receives more
The male heir carries the financial responsibility for his wife, children and family, while a woman's wealth is entirely her own. The larger share reflects greater obligation, not greater value.
Worked Example
Estate Rs 10,000,000. Heirs: wife, 2 sons, 1 daughter.
- Wife (with children) = 1/8 = Rs 1,250,000
- Remaining Rs 8,750,000 split as 2+2+1 = 5 parts.
- Each son = Rs 3,500,000; daughter = Rs 1,750,000
